The following are the Terms of Use (“Terms”) that govern the use of www.apexreptile.com (hereinafter referred to as the “Site”). When the term “Site” is used we are referring to all areas of the website knows as www.apexreptile.com. This shall include, but not be limited to, all areas of the Site that involve the purchasing of products or services, the explanations and details of products, the blog posts, any newsletter or information voluntarily provided by Apex Cages/Apex Reptile and any areas of the Site that allow you to input information regarding yourself. These Terms, including the Apex Cages Purchase Policy, Return Policy, Privacy Policy and any other policies, rules or guidelines that may be applicable to particular offers or features on the Site are hereby incorporated by reference into these Terms.

“Enclosure(s)” or “cage(s)” refers to all terms and trademarks with Apex Cages and all content and design used through the actual enclosures, products, services and the site. By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site and the Enclosure. Apex Cages reserve the right to change these Terms, and any other policies, terms, rules, regulations, and guidelines at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically.

PERMITTED USE: You agree that you are only authorized to visit, view and to retain a copy of pages and any content of this Site for your own personal use, and you agree not to duplicate, download, publish, modify or otherwise distribute the material on this Site or the products or any purpose other than to review information and or purchase for personal use unless otherwise specifically authorized by Apex Cages to do so.

Apex Cages reserves the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks (b) changes to conform and adapt technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit and portion of the Enclosure, products, services or website without express written permission from Apex Cages.

The sale or purchase of an enclosure or any product from Apex Cages may be regulated by certain national, state/province, county and city laws or regulations. You acknowledge that complying with laws is your responsibility, AND YOU AGREE NOT TO HOLD APEX CAGES LIABLE FOR YOUR FAILURE TO COMPLY WITH ANY LAW OR APEX CAGES’ FAILURE TO NOTIFY YOU OF, OR PROPERLY APPLY, ANY LAW. APEX US CORP WILL COMPLY WITH LAW ENFORCEMENT AND MAY PROVIDE THEM WITH ALL INFORMATION YOU SUBMIT TO US TO ASSIST IN ANY INVESTIGATION OR PROSECUTION THEY MAY CONDUCT. YOU AGREE NOT TO HOLD APEX CAGES RESPONSIBLE FOR ANY DAMAGES CAUSED BY THE USE OF THE PRODUCT. You represent and warrant that all information you provide, including but not limited to all information concerning your name, address, credit card number, and other identifying information of any nature will be true, complete and correct. You agree that you will only use credit cards belonging to you or agents who have expressly authorized such use, for the purpose of purchasing an enclosure or products through Apex Cages and apexcages.com. Suspected Violation of these Terms of Use or Law; Injunctive, Equitable Relief, and Liquidated Damages. Violations of these Terms of Use, including Unauthorized Use of the Enclosure or other products, Copyright violations, copying, sharing, may be investigated and appropriate legal action may be taken, including without limitation civil, criminal and injunctive redress. If we are unable to verify or authenticate any information that you provide during ordering, purchase, payment or remittance process, or any other process, or if we are no longer able to verify or authorize your credit card or bank account information, your order may be cancelled, we may refuse to honor all pending and future purchases made on such credit card accounts and/or on any online accounts associated with such credit card accounts, and you may be prohibited from using our services. We believe that your privacy and the privacy of all our users is important.

It is the customer's responsibility to evaluate their enclosure for the safety, security, and well being of their animal. We are not responsible for animals escaping or any consequences resulting from any such incident. We are not responsible for any violation of the law due to housing of illegal animals. We are not responsible for fire danger associated with any products. Follow all manufacturers' guidelines and ratings when using any such lighting or heating products. All heating or lighting elements are installed at customer's own risk. Be sure to use appropriate power cords and outlets with any lighting and heating fixtures. Contact the manufacture of the fixture if you are unsure of proper power cord requirements.

Apex Cages will not be responsible or otherwise liable for any use or disclosure of your contact information, or financial information, by a third party to whom Apex Cages is allowed to disclose your contact information under the Privacy Policy.

The sale or purchase of an Enclosure or other products by a third party is governed by these terms of use. The Enclosure and products may only be sold for retail value and may not be discounted, put on sale, or any other means of reducing price without written consent from Apex Cages. Apex Cages holds the right to discontinue selling Enclosures and other products if any company violates regulations set forth.

ELECTRICAL COMPONENTS: Our electrical products, including but not limited to the items incorporated in the build of the Enclosure or purchased separately, are not manufactured by Apex Cages or specifically for reptile use. Apex Cages nor the manufacturers will be held liable for damages caused by malfunctions, improper use, etc. By purchasing an Enclosure from Apex Cages with an electrical component, you are fully aware of the dangers of heating and electrical products. You are responsible for inspecting the Enclosure and products for safety and electrical wattage and compatibility in your region and outlet you are using. By purchasing a product with an electrical component you are specifically asking Apex Cages to install and/or provide heating electrical elements that are commonly used in the industry, but are not approved by the manufacturer of the heating elements for this specific use. Apex Cages and the manufacturer of the electrical components will not be held responsible for malfunctions of the electrical elements because they are not specifically intended for use in this application.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to our ALL SALES ARE FINAL POLICY. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

MODIFICATIONS TO PRODUCTS, SERVICES, AND PRICES: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue a product or service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of a product or service. Prices are in US Dollars and we only accept US Dollars. Please note we are not responsible for any exchange fees or rates your financial institution may charge you for international purchases.
